Welcome to DeployKey! These Terms and Conditions (“Terms”) govern your use of our services and products, including installation/setup services and the purchase of digital products such as license keys and digital downloads. By accessing our website or using our services, you agree to be bound by these Terms.

1. Services and Products

a. Installation/Setup Services

We provide installation and setup services for eligible software or products. It is your responsibility to ensure that your system meets the necessary requirements for the service to be performed.

b. Digital Products

Our digital products include but are not limited to software license keys and downloadable content. All digital products are delivered electronically via email or direct download after payment is confirmed.

2. Refund Policy

• Refunds for installation/setup services are available within 7 days of the service date only if the service was not performed correctly or as described.

• Refund requests must be submitted in writing to our support team, including proof of the service issue.

• No refunds are provided for license keys or digital downloads once the purchase has been completed.

• Customers are advised to verify system compatibility and product requirements before purchasing any digital product.

3. Customer Responsibilities

• You agree to provide accurate, current, and complete information for all purchases and communications.

• You are responsible for maintaining the confidentiality of your account and any access credentials.

• You agree not to use our services for any unlawful or prohibited activity.

4. Intellectual Property

All content, including logos, product descriptions, software, and documentation, is the property of DeployKey or its licensors and is protected by copyright, trademark, and other intellectual property laws. Unauthorized use is strictly prohibited.

5. Limitation of Liability

To the maximum extent permitted by law, DeployKey shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of our products or services.

6. Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof—including the determination of the scope or applicability of this agreement to arbitrate—shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), or another mutually agreed-upon arbitration provider.

• Location: The arbitration shall take place in Nashville, TN unless otherwise agreed by both parties.

• Governing Law: The arbitration shall be governed by the laws of the United States.

• Costs: The customer agrees to bear all costs and expenses associated with the arbitration, including arbitrator fees, administrative fees, and any legal expenses incurred by either party.

• Waiver of Class Actions: You agree to resolve disputes with us on an individual basis only, and not as a plaintiff or class member in any purported class or representative proceeding.

By agreeing to these Terms, you waive your right to a trial by jury or to participate in a class action or representative proceeding.

7. Modifications to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
